NOTICE OF PUBLIC HEARING

A Public Hearing will be heard before the Safety Services & Licenses Committee on Monday, April 2, 2018 at 6:30 p.m. Cranston Council Chambers, City Hall, 869 Park Avenue, City Hall, Cranston, R.I. pursuant to Section 3.12 of the Charter on the following proposed Ordinance.

Copies of all proposed Ordinances are available for public review at the City Clerk’s Office, Cranston Central Library and on the City website: cranstonri.com under calendar by clicking the Committee meeting date.

“Individuals requesting interpreter services for the deaf or hard of hearing must notify the City Clerk’s Office at 461-1000 ext. 3197 seventy-two (72) hours in advance of the hearing date.”

PROPOSED ORDINANCE NO. 3-18-01 IN AMENDMENT OF SECTION 5.04.070 OF THE CODE OF THE CITY OF CRANSTON, 2005, ENTITELD “LICENSES GENERALLY” (SAFETY SERVICES COMMITTEE)

It is ordained by the City Council of the City of Cranston as follows:

SECTION 1. Section 5.04.070 of the Code of the City of Cranston entitled “Licenses Generally - Revocation for Breach of Peace, Safety and General Welfare“ is hereby amended as follows:

The members of the Safety Services and Licenses Committee, after hearing with due notice to licensee, shall revoke a license and or levy fines to insure compliance with the Cranston City Code under this chapter if said Committee finds that activity from within the licensed premises proximately cause a nuisance, to wit, activity that

A. Disrupts the peace and order within the municipality.

B. Threatens the health, safety and general welfare of the inhabitants of the municipality.

C. Eliminates the quiet enjoyment, comfort and convenience of the municipality and its inhabitants.

In addition to the power to revoke the license holder’s license, the City of Cranston Safety Services Committee shall have the power to hear and adjudicate violations any and all violations. Said hearings shall be conducted under oath and with witnesses called before the Committee. In the event that the license holder is found to be in violation of the license holder’s responsibilities, said Committee upon a vote of the preponderance of the Committee, shall have the power to levy fines based upon the severity of the offense. The maximum fine levied shall not exceed $500.00.

Section 2. This Ordinance shall take effect upon its final adoption.
