PROPOSED ORDINANCE NO. 4-20-01 IN AMENDMENT OF TITLE 10.32 OF THE CODE OF THE CITY OF CRANSTON, 2005 , ENTITLED “MOTOR VEHICLES AND TRAFFIC” (Scaralia & Fox Ridge Dr. – 4
way stop removal)

It is ordained by the City Council of the City of Cranston as follows:

SECTION 1. Title 10.32.030 of the Code of the City of Cranston, 2005 entitled “Multi-way Stop Intersections -Enumerated” is hereby amended by deleting the following:

[Scaralia Road and Fox Ridge Drive, 4 way stop]

SECTION 2. Title 10.32.020 of the Code of the City of Cranston, 2005 entitled “Stop Intersections Enumerated” is hereby amended by adding the following:

Scaralia Road at its intersection with Fox Ridge Drive

SECTION 3. This Ordinance shall take effect upon its final adoption.

PROPOSED ORDINANCE 4-20-05 IN AMENDMENT OF TITLE 10.32.040 OF THE CODE OF THE CITY OF CRANSTON, 2005, ENTITLED “MOTOR VEHICLES AND TRAFFIC – NO PARKING ON CERTAIN STREETS - GENERALLY”
(Barrett St.)

It is ordained by the City Council of the City of Cranston as follows:

SECTION 1. Title 10.32.040 of the Code of the City of Cranston, 2005 entitled “No Parking On Certain Streets - Generally” is hereby amend to include the following no street parking on the following street:

There shall be no street parking sign erected on both sides of Barrett Street commencing at 56 Barrett thorough the end of the street and no vehicles shall be permitted to park facing the guard rail at the end of Barrett Street or adjacent to the guard rail at the end of Barrett Street.

SECTION 2. The fines for any violation of this ordnance shall be determined by Ordinance 10.04.030.

SECTION 3. This ordinance shall take effect immediately upon passage.

PROPOSED ORDINANCE 4-20-07 IN AMENDMENT OF TITLE 5, OF THE CODE OF THE CITY OF CRANSTON, 2005, ENTITLED “BUSINESS LICENSES AND REGULATIONS”
(Third Party Delivery Services)

It is ordained by the City Council of the City of Cranston as follows:

Section 1. Title 5, Chapter 5.80 is hereby amended by adding the following:

5.80.080 Third Party Delivery Services

Definitions:
As used in this subchapter, the following terms have the following meanings:

a) “Covered establishment,” means any food service establishment as defined by Rhode Island General Law section 21-27-1(9), that offers, in a single commercial transaction over the internet, whether directly or through a third-party application, the sale and same-day delivery of food to customers from one or more retail locations within the City of Cranston.

b) “Third-party food delivery service,” means a company, organization, or entity outside of the operation of the food service establishment’s business that provides a limited delivery service to customers.

Commission Disclosure:
When a final price is disclosed to a customer, and before a transaction occurs, for the purchase and delivery of food from a covered establishment through a third-party food delivery service, such third-party food delivery service shall disclose to such customer, in plain and simple language and in a conspicuous manner, any commission, fee, or any other monetary payment imposed by the third-party food delivery service on such covered establishment as a term of a contract or agreement between the parties in connection with the covered establishment utilizing the third-party delivery service.

Any covered establishment may decline to disclose to customers the commission charged by a third-party delivery service. If a covered establishment has declined to have such a commission disclosed to customers, the requirement of subsection (b) shall not apply with respect to such covered establishment.

Delivery Disclosure:
When a final price is disclosed to a customer, and before a transaction occurs, for the purchase and delivery of food from a covered establishment through a third-party food delivery service, such third-party food delivery service shall disclose to such customer, in plain and simple language and in a conspicuous manner, if the covered establishment offers their own first-party delivery service.

Fees:
It shall be unlawful for third-party food delivery services to charge covered establishments a fee per online order for the use of their services that totals more than 10% of the purchase price of such online order.

Telephone Orders:
No third-party food delivery service may charge a commission from a covered establishment for a telephone order that does not result in an actual transaction between the covered establishment and a customer during such telephone call, or that exceeds the established commission rate between the third-party food delivery service and covered establishment.

Penalties:
Any person or entity who shall violate any of the provisions of this ordinance shall be fined $100 for each violation.

Section 2: This Ordinance shall take effect upon its final adoption.
