A Public Hearing on the following proposed Ordinances will be held before the Ordinance Committee on Thursday, April 13, 2023 at 6:30 p.m. in the City Council Chambers, City Hall, 869 Park Avenue, City Hall, Cranston, R.I. pursuant to Section 3.12 of the Charter, in accordance with the RI General Laws Chapter 45-24-53 for the purpose of considering the following items listed on the agenda.  Remote participation is also available by using the logon information provided below as posted on the City’s website at www.cranstonri.gov and Secretary of State’s website at www.sos.ri.gov.

PROPOSED ORD. NO. 3-23-02 IN AMENDMENT OF TTITLE 10, CHAPTER 32 OF THE CODE OF THE CITY OF CRANSTON, 2005, ENTITLED “MOTOR VEHICLES AND TRAFFIC – NO PARKING - COMMERCIAL VEHICLES” (Kenwood Street both sides)

 

It is Ordained by the City of Cranston City Council as follows:

 

    Section 1. Title 10, Chapter 32 is hereby amended by adding the following:

    10.32.225 – No Parking – commercial vehicles

    Except when actively engaged in lawful loading, unloading, or other customary and active business activities at properties located on the following streets, highways, or parts thereof, no commercial vehicles or commercial vehicle attachments (including, but not limited to, motor trucks, semi-trucks, box trucks, motor homes, campers, buses, truck tractors, trailers, semitrailers, cargo trailers, flatbeds, car carriers, or fifth wheels) shall be parked, stored, or remain standing for any period of time within or upon any of the following streets or highways or parts thereof:

 

    Kenwood Street, both sides, from National Grid Pole #11 northerly for a distance of     one thousand one hundred (1100) feet.

 

    Nothing in this section 10.32.225 shall be construed to prohibit the use of any street or highway for the free and lawful movement of commercial vehicles and commercial vehicle attachments

   

    Section 2. This Ordinance shall take effect upon its final adoption.

PROPOSED ORD. NO. 3-23-03 IN AMENDMENT OF TITLE 10, CHAPTER 04, SECTION 030 OF THE CODE OF THE CITY OF CRANSTON, 2005, ENTITLED “MOTOR VEHICLES AND TRAFFIC – PENALITIES FOR TRAFFIC VIOLATIONS”

 

It is Ordained by the City of Cranston City Council as follows:

 

    Section 1. Title 10, Chapter 04 and Section.030 is hereby amended by adding the following:

Commercial vehicles parking in violation of 10.32.225 First violation                            $150.00.

 

Commercial vehicles parking in violation of 10.32.225 Second violation                         $250.00.

 

Commercial vehicles parking in violation of 10.32.225 Third and subsequent violations         $500.00

   

    Section 2. This Ordinance shall take effect upon its final adoption.

IN AMENDMENT OF TITLE 10, CHAPTER 28, SECTION 090 OF THE CITY OF CRANSTON CODE OF ORDINANCES, 2005, ENTITLED “MOTOR VEHICLES AND TRAFFIC - ALL NIGHT PARKING PROHIBITED”

 

It is Ordained by the City of Cranston City Council as follows:

 

Section 1.  Title 10, Chapter 28, Section, 090 is hereby amended by adding the following:

(It shall be unlawful for the operator of any vehicle to park the same on any street for a period of time longer than two hours between the hours of 1:00 a.m. and 7:00 a.m. of any day.) 

Section 091 On-street overnight

The City of Cranston shall issue on-street overnight parking permits on one side of residential streets to applicants seeking additional parking if they meet the eligibility criteria.

The Cranston Department of Public Works shall designate the parking slots by using signage on one side of any street except:

  1. One Way Street.
  2. State roads.
  3. In front of the Water hydrant.
  4. In front of driveways.

No parking slot should be designated on the opposite side of any driveway.

The applicant shall request parking permits from the Cranston Police department which will issue the permit by designating a color for this special permit.

10.28.092 Applicant’s eligibility criteria

The owner of a single-family home whose household is comprised of 4 adults who have a valid driver’s license shall apply for one (1) on-street parking permit.

The owner of a multi-family home shall apply for one (1) on-street overnight parking permit per unit if only the unit has four adults with a valid driver’s license.

The owner of a house without parking shall apply for on-street overnight parking for each unit.

10.28.093 _Fees

The on-street overnight parking fees shall not exceed $100 per year per permit renewable.

 

10.28.094_ Enforcement

The Cranston Police department is the authority to enforce the provision of this ordinance.

Overnight parking permits shall be always displayed on the front and on the right side of the vehicle.

It is unlawful for the operator of the vehicle to park overnight on any street without an on-street overnight permit.

 

In the event of said violation, the municipal judge hearing the action shall be vested with the judicial discretion to dismiss the ticket(s) or impose or waive the court costs in lieu of the payment of the ticket(s) fine based upon the severity of the violation before the court, the violator’s history of overnight parking without permit incidents and/or prior warnings issued. In no instance shall the court cost(s) imposed by the municipal judge be less than (twenty dollars ($20.00))  fifty dollars ( 50.00) or more than (thirty-nine dollars ($39.00))  sixty dollars ( 60.00) per offense.(

    Section 2.   This ordinance shall take effect upon its final adoption.
